Egzekucja sądowa w Polsce

Podstawowym aktem prawnym, który reguluje sądowe postępowanie egzekucyjne w sprawach cywilnych jest Kodeks postępowania cywilnego ( ustawa z 17 listopada 1964 r.,
Dz. U. Nr 43, poz. 296 ze zm.), a zwłaszcza część trzecia Kodeksu pt. „ Postępowanie egzekucyjne” (art.758-1088). Zgodnie z art. 758 kpc sprawy egzekucyjne należą do właściwości sądów rejonowych i działających przy tych sądach komorników. Czynności egzekucyjne są wykonywane przez komorników, z wyjątkiem czynności zastrzeżonych dla sądów.
Komornik sądowy jest funkcjonariuszem publicznym działającym przy sądzie rejonowym.

Status komornika sądowego, jego prawa i obowiązki, zasady odpowiedzialności dyscyplinarnej, kwestie nadzoru nad komornikiem sądowym, zasady prowadzenia kancelarii komorniczej, ustrój i kompetencje samorządu komorniczego określone zostały w Ustawie z dnia 29 sierpnia 1997 r. o komornikach sądowych i egzekucji ( tekst jedn. Dz. U. z 2006 r. Nr 167, poz. 1191 ze zm.).
Polska jest partnerem w ramach projektu EJE ( Egzekucja Sądowa w Europie), którego celem jest poprawa egzekucji wyroków sądowych w Europie.
