Enforcement law in Belgium

The judicial officer personifies the law on enforcement in Belgium.

As a key legal figure in the field, it is his responsibility to translate into action the rights and obligations of each of the parties to a dispute, as established in a title with executive force (whether this title takes the form of a court decision, a notarial instrument or an administrative document).

To do this, the judicial officer has a whole series of instruments at his disposal, which include the enforcement measures defined by the Belgian Judicial Code.

In practical terms, the purpose of these compulsory execution measures is to enable the creditor to obtain possession of items of property from the debtor’s assets if the latter fails to comply voluntarily with an enforceable title issued against him.
